Madras High Court IN THE CASE OF Annai Enterprises v. Deputy State Tax Officer
Relief to the assessee was granted after the Court found that the matter deserved reconsideration in light of the statutory provisions and the GST Amnesty Scheme.
The Court emphasized that Section 128A is a beneficial provision intended to grant waiver of interest and penalty in eligible cases upon payment of tax and fulfillment of prescribed conditions.
Authorities should not deny the benefit of the Amnesty Scheme on mere technical or clerical errors when the original assessment records clearly establish eligibility.
A hyper-technical approach should not defeat the object of a beneficial statutory scheme meant to reduce pending GST disputes.
While considering applications under Section 128A, the proper officer must verify the original assessment records instead of relying mechanically on summary entries.
Interest liability under Section 50 and proceedings under Sections 73 and 75(12) must be examined in accordance with the statutory framework before rejecting relief.
Procedural defects or portal-related mistakes should not deprive a taxpayer of substantive relief if the legal conditions for amnesty are otherwise satisfied.
The Court reiterated that substantive justice should prevail over procedural irregularities, particularly in matters involving waiver schemes.
The matter was remitted to the GST authorities for fresh consideration, directing them to decide the assessee's claim under Section 128A on its merits and in accordance with law.
