BOMBAY HIGH COURT IN THE CASE OF High Performance Plastics India Pvt. Ltd

In a recent case, the taxpayer’s refund claim was rejected because certain required documents were not submitted at the initial stage. Later, the taxpayer provided those documents during the appeal process, but the authorities refused to accept them.

The main issue was whether additional documents can be submitted at the appeal stage.

The Court observed that rejecting such documents outright is not correct. There are valid situations where a taxpayer may not be able to submit all documents earlier due to genuine reasons. In such cases, authorities should consider the additional evidence instead of ignoring it.

The Court also highlighted that if new documents require verification, the matter can be sent back for proper examination rather than rejecting the claim completely.

Finally, the Court set aside the earlier order and directed the authority to reconsider the case after taking into account the additional documents submitted by the taxpayer.
