BOMBAY HIGH COURT IN THE CASE OF Interactive Brokers Software Services Private Limited
In a recent case, the High Court dealt with a refund rejection where the taxpayer’s claim was denied on the ground that required documents were not submitted. However, the taxpayer argued that all necessary documents, including FIRC and export invoices, were already provided.
The Court observed that the officer failed to properly examine the documents on record and passed the order without proper application of mind. Instead of deciding the matter finally, the Court directed the department to re-examine the refund claim and consider all documents before passing a fresh order.
Authorities must verify documents carefully before rejecting refund claims. A mechanical rejection can be challenged in court.
